By accessing or using LitWrite ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not access or use the Service. We reserve the right to update or modify these terms at any time, and your continued use of the Service following any changes constitutes acceptance of those changes.
Subject to your compliance with these Terms, LitWrite grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes. This license does not include the right to:
You retain full ownership of all text, manuscripts, notes, and other materials you create, upload, or store using LitWrite ("User Content"). We do not claim any intellectual property rights over your User Content. By using the Service, you grant LitWrite a limited license to store, process, and transmit your User Content solely for the purpose of operating and improving the Service, including syncing your work across your devices.
You are solely responsible for the content you create and store through the Service. You agree not to use LitWrite to create, store, or distribute content that is unlawful, defamatory, or infringes upon the rights of others.
The Service, including its original content, features, functionality, design, and branding, is and remains the exclusive property of Lit Corp and its licensors. The LitWrite name, logo, and all related trademarks, service marks, and trade names are the property of Lit Corp. Nothing in these Terms grants you any right to use the LitWrite brand or marks without prior written consent.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may export your User Content at any time before termination. We will make reasonable efforts to allow you to retrieve your data for 30 days following account termination, after which your data may be permanently deleted.
To the maximum extent permitted by applicable law, LitWrite and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or interruption of service, arising out of or related to your use of the Service. In no event shall our total liability exceed the amount you have paid to LitWrite in the twelve months preceding the claim.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware. You consent to the personal jurisdiction of such courts.
